TERMS OF SERVICE
Training sessions and Appointments that are not canceled at least 24 hours prior to the scheduled time will be forfeited. The only exception to this policy will be a medical emergency with documentation. Failure to give proper notice (24-hour notice) may lead to automatic forfeiture of the session.
ALL training packages/memberships have an expiration date on the sessions. Any sessions that remain after the expiration date will be forfeited. The session packages will expire at the end of the agreed term that they were purchased. Exceptions to this policy include
· Extended leave of absence.
· A medical condition that prohibits physical activity associated with training, physician communication is preferred in this situation.
If you have unused sessions left and you are unable to complete the sessions due to health reasons, enrollment status, or other extenuating circumstances you may be eligible partial refund for unused sessions. This refund is based upon the approval from the ATLAS Pro Training LLC Management team.
The first initial training session must be paid in full prior to scheduling your first session with the Atlas Trainer by either paying the single session rate, a training package, or membership
If the client arrives more than 15 minutes late for a scheduled appointment, the trainer may deny access to the premises and the appointment will be forfeited.
ALL Participants over the age of 16 may be required to have medical clearance if deemed necessary by their Par-Q and health history information.
3. Payment & EFT Authorization:
By signing a monthly membership training agreement you hereby authorize Atlas Performance Training LLC DBA as Atlas Pro Training LLC to transfer electronic funds on a recurring basis from the checking, savings, or credit/debit card account I specified below for my monthly Membership Fees, and any cancellation fees, late charges or other fees or charges due and payable in connection with this Agreement. This authorization is to remain effective until Atlas has collected all fees and/or charges assessed in connection with the terms and conditions of this Agreement, including any late fees, cancellation fees, and other similar fees or charges provided under this Agreement. There will be a $35.00 insufficient funds charge in addition to any other charges incurred to recover any returned payments during the term of this Agreement. I hereby agree that if Atlas is unable to process my payment from the designated account provided by me, Atlas is permitted to use any of the other account(s) information provided as many times and as often as needed to replace the unpaid payments, including any cancellation fees, late fees or service charges as provided in this Agreement. The Client agrees to pay a late fee/service charge of $20.00 for any payments that are ten (10) days past due, in addition to the $35.00 fee for any EFT transfer that is returned for insufficient funds. If there are three (3) payments that are ten (10) or more days past due during the period of this Agreement, then the Client shall pay the remaining balance of all fees and charges due under this Agreement in full, in addition to any and all recovery charges incurred. By signing this document, I am authorizing the automatic electronic withdrawal of the agreed-upon funds to be debited from my credit/debit card, or EFT checking/savings account by auto-draft payment for the Term of this Agreement (including any renewal Term) on the agreed-upon dates and payment frequencies (i.e., monthly, weekly) as set forth in this Agreement. To terminate, you must give written notice of termination to Atlas in accordance with paragraph 11 of the Training agreement.
Public Image/License:
The client hereby agrees that Atlas or any party designated by Atlas may video, live stream, photograph, or film me while I attend the training sessions, and Atlas may use and post any and all such photos, video footage, and/or video streaming for promotion, print materials, sales, publicity and advertising purposes for all media, including, but not limited to, the internet (i.e., Facebook, Instagram, Twitter, and other internet media).
By scheduling and completing the intake form for any of the services on the Atlas Pro Training LLC website, you are consenting to the use of your contact information to contact you or your representative regarding additional services and information by email, text, or mail.
